CHAMOIS — A Chamois man faces a felony stealing charge after he allegedly took musical instruments, archery equipment, toys, electronics, clothing, military items, and collectible cards from a vehicle.
James P. Cox, of Chamois, was charged on Aug. 20 in Osage County with the class D felony of stealing $750 or more.
According to a probable-cause statement filed by Cpl. Bell of the Osage County Sheriff’s Office, dispatchers received a report at approximately 6:30 a.m. Aug. 19 of a witnessed theft from a motor vehicle. Two witnesses reportedly said they saw Cox enter a red Dodge Durango belonging to the victim at approximately 4:30 a.m., remove items, and take them to his residence. The witnesses identified Cox as their neighbor.
Bell reported contacting Cox at his parents’ residence. After being advised of his Miranda rights, Cox allegedly admitted taking several items and said they were in the trunk of his car. According to the statement, Cox consented to a search of the vehicle.
Deputies reportedly recovered three guitars, a mandolin, two arrows, a draw bow, five Nerf guns, and related ammunition with a combined estimated value of $1,284.
The victim reported that two additional guitars, clothing, a Dell laptop, a Marine Corps woodland camouflage tarp, and a dresser drawer containing approximately $1,000 worth of collectible Yu-Gi-Oh! cards remained missing. Those items had a combined reported value of $1,790.
During a follow-up interview, Cox allegedly said he had thrown a box containing clothing and other items he could not recall into the dumpster outside his apartment. He reportedly told Bell that the dumpster had already been emptied by the trash company.
Cox was arrested at 10:51 a.m. on Aug. 19, according to the probable cause statement. Court records indicate a warrant issued in the case was served at 9:47 a.m. on Aug. 20.
The court set a $2,000 cash-only bond. In addition to the standard conditions of release, Cox was ordered not to contact the victim, the victim’s children, or the victim’s family. He was also ordered to observe a curfew from 10 p.m. to 6 a.m., except when required for employment or medical or drug treatment, and to obtain and maintain employment.
A case review is scheduled for 10 a.m. on Tuesday, Aug. 25, before Judge Sonya D. Brandt in the Osage County courtroom.
The allegations contained in the charge have not been proven in court.
