LINN — A Linn man was arrested Jan. 29 following an alleged domestic incident that led to charges of third-degree kidnapping and third-degree domestic assault.
According to a probable cause statement filed by the Osage County Sheriff’s Office, Sgt. Richard Jarvis was dispatched at approximately 8:07 p.m. to a protected address in Osage County for a report of a fight in progress. While en route, emergency dispatch advised that the suspect, identified as Gavin C. Daniels, had left the scene in a silver Lincoln SUV driven by a female. Dispatch also advised that the victim had left the scene and was returning to her residence in Owensville.
Upon arrival, Jarvis made contact with a resident identified as Witness 1, who stated Daniels had been drinking and was intoxicated. The witness said Daniels’ girlfriend, the victim, was also at the residence. According to the statement, the witness said Daniels accused the victim of cheating and became agitated. The victim went into the bathroom to get away from Daniels, and Daniels followed her into the bathroom and held the door shut, preventing her from leaving.
After about 10 minutes, the victim was able to exit the bathroom. The witness said she then attempted to separate herself by going outside and getting into the passenger seat of a vehicle. The witness said Daniels attempted to get into the driver’s seat and would not allow the victim to exit the vehicle.
The victim later exited the vehicle and again attempted to separate herself, at which point the witness said Daniels grabbed her and attempted to force her back into the vehicle, ripping her leggings during the altercation.
According to the statement, the witness then placed Daniels in a choke hold and rendered him unconscious. The witness said Daniels later regained consciousness and attempted to assault him, at which point the witness again placed him in a choke hold until Daniels was unconscious. A silver Lincoln SUV later arrived, picked Daniels up and left the property.
Jarvis reported he contacted the victim by phone while on scene. The victim provided the same account as the witness and stated she did not have any physical signs of injury. The victim said the witness had given her a pair of pants to wear, and she left the residence with another female and was en route back to her Owensville residence at her parent’s request.
While at the scene, Jarvis located a ripped piece of leggings in the driveway. The victim stated the remaining portion of the leggings was inside the residence and was later retrieved. Photographs were taken of both pieces, according to the report.
After Jarvis left the scene, the witness called by cell phone to report that the victim had returned to the residence. While they were on the phone, the witness told Jarvis that Daniels had arrived again in the silver Lincoln SUV and entered the home demanding to speak with the victim. Jarvis said he heard the witness tell Daniels to leave multiple times before the witness said Daniels left the residence traveling northbound on Hwy. 89 South.
Jarvis located the vehicle traveling northbound on Hwy. 89, confirmed the registration through dispatch, and conducted a traffic stop at the Breaktime gas station in Linn, at the intersection of Hwy. 89 South and East Main Street. Daniels was located in the passenger seat and was taken into custody.
Daniels was transported to the Osage County Detention Center, where he was booked and placed on a 24-hour hold pending formal charges. He was formally charged the following day, and a no-bond warrant was issued by Judge Sonya Brandt. Daniels is currently being held at the Osage County Detention Center. No court date has been set in the matter at the time of this writing.
