Osage County deputies arrest man following late-night incident at Linn apartment complex

OSAGE COUNTY — A Linn man, Kevin S. Padilla, was taken into custody late Thursday night after allegedly fleeing from deputies responding to a disturbance at an apartment complex. Official charges had not yet been filed as of Monday morning.

According to an arrest report from the Osage County Sheriff’s Office, deputies were dispatched to Northern View Apartments at approximately 11:20 p.m. on Oct. 16 after reports of a peace disturbance. Deputy Dawson Haslag, accompanied by Cpl. Aaron Bell and Maj. Travis Shaffer, arrived to find several individuals gathered outside. The report stated that some appeared to be under the influence of alcohol, and at least one was identified as a minor.

Deputy Haslag reported observing Padilla holding an alcoholic beverage. When approached, Padilla allegedly admitted he did not have a valid driver’s license in his possession. The deputy stated he then asked Padilla to accompany him to his patrol vehicle.

According to the probable cause statement, Padilla attempted to flee on foot after being given a verbal directive to stop. A short foot pursuit ensued, ending when Bell assisted in apprehending Padilla. He was then arrested for resisting lawful detention.

The report cites Missouri Revised Statute 575.150, which defines resisting or interfering with arrest as an offense that occurs when a person uses or threatens violence, physical force, or flees from an officer attempting to make an arrest or lawful stop. The statute further notes that the offense is typically a Class A misdemeanor, but may be elevated to a Class E felony if the suspect’s actions create a substantial risk of serious injury or death.

The incident report noted that Padilla was arrested at 11:46 p.m. and booked at the Osage County Detention Center. He was later released pending formal charges.

No additional charges related to underage drinking or public intoxication were listed in the report. Nor does the document indicate whether any of the minors observed at the scene were cited.

As of press time, the Osage County Prosecutor’s Office had not filed formal charges.
