Fain charged with drug possession

Ryan A. Fain, 36, of Chamois, has been charged with possession of a controlled substance and delivery of a controlled substance except 35 grams or less of marijuana following a traffic stop on June 26.

Det. David Neumann stopped a vehicle on US 50 east of Linn at about 3:25 p.m. for crossing the solid white fog line with its passenger tires. Neumann noted this vehicle was observed leaving an address off Hwy. 50 just before the stop.

Det. Neumann contacted Fain and advised him of the reason for the stop. During the enforcement contact, Fain said he noticed an odd vehicle that stuck out to him, and he turned around and looked over his shoulder.

In his probable cause statement, Neumann noted that Fain was talkative, shaky, and his breathing seemed labored. Neumann inquired about the presence of narcotics or other illegal contraband, and Fain replied there “shouldn’t be” anything in the vehicle.

According to Neumann, Fain was hesitant but gave consent to search. During the search, Neumann located and seized a zippered pouch containing numerous (much more than 10) small plastic baggies commonly used for packaging narcotics before the sale.

In the bottom of the pouch and supporting this theory, Neumann noticed small white particles consistent in appearance with methamphetamine. The particles later field-tested positive for the presence of meth.

Neumann executed a narcotics-related search warrant at Hwy. 50, during which he located a large number of items under a blue tarp at the rear of the house. Among those items was a black zippered pouch containing multiple narcotic-related items, including many clear plastic bags believed to be used in narcotics distribution, a functioning digital scale with drug residue on it, and a clear plastic bag containing a crystal rocklike substance, field-tested positive for the presence of approximately 16 grams of meth.

Fain was arrested at about 4:30 p.m. and transported to the Osage County Detention Center.

Judge Sonya Brandt set Fain’s bond at $50,000 cash or surety.
